Man Sues Trump Resort for Injuries on Pool Deck

A man from New Jersey has filed a lawsuit against Trump International Beach Resort, Florida, for negligence. He claims that the burns he suffered on his toe and foot were caused by the heated pool deck and sand.

Theoharis Lekas filed a suit in New York Supreme Court Friday alleging the resort’s negligence for not posting signs that recommended footwear. Lekas says that surfaces in the resort were “scorching” hot during his vacation of August 2022, causing him to suffer “devastating third-degree burns” on both feet. He claimed that he couldn’t feel the heat of his feet while walking across the blistering deck, as he has diabetic neuropathy.

Plaintiffs Seeking “Near $1 Million”

The lawsuit, is seeking an amount that has not been disclosed. However, Bill Matsikoudis of the firm that represents Lekas indicated that damages would likely be “norther than $1 million”. The lawsuit claims that the resort did not mitigate temperatures by placing mats on the floor or washing it with water. The lawsuit claims that the resort failed to warn guests about the hot surfaces by posting signs and other warnings.

The resort, although not owned directly by the former president Donald Trump, is under The Trump Organization. He is the founder and major owner of this organization. The lawsuit alleges that the resort “outlets its collaboration” (with the real estate mogul)

Lekas claimed that the resort owed a duty to him to prevent “even uncommon hazards.” Matsikoudis & Fanciullo LLC filed a lawsuit for an amount that has yet to be “fixed” by the court and claimed it filed with the Supreme Court as the amount would exceed the jurisdictional limitations that lower courts can impose.

Lekas claims that he was severely burned and suffered life-changing injuries because the resort failed to warn him of the scorching surfaces. Trump International is also accused of failing to reduce the temperature by using mats and hosing the floors down with water.

Injury Resulting in Amputation

Lekas claimed that he did not notice his peeling feet until the last day of his vacation, when putting on socks. The lawsuit states that upon returning home, his condition had deteriorated so much that he was forced to bandage his severely burned feet and rush to hospital. His left foot was healed but his right foot developed a “bullet hole-shaped ulcer” that “grew deeper and wider until it reached bone.” After a second 16-day stay in the hospital, doctors had to amputate the foot.

The lawsuit also stated that the wound is not healing, which poses a serious threat to Lekas’ health. He has been told that “further surgeries are expected.” Lekas claims he continues suffering damages, including bodily injuries, pain and discomfort, mental, physical, and emotional anguish, as well as loss of income and significant medical expenses.
