Hot Tub Cover Law – New Law signed into Legislation

(Albany NY) – On November 23, Governor Kathy Hochul signed AB8646 into law. This allows spa owners and operators of hot tubs to meet the state’s safety requirements by using ASTM 1346 compliant safety cover. This requirement is identical to the International Swimming Pool and Spa Code, (ISPSC), and the next editions of the International Property Maintenance Code.

The Pool & Hot Tub Alliance, International Hot Tub Association IHTA (IHTA) and the Northeast Spa & Pool Association all played a key role in passing this law. These associations and PHTA’s New York-based public relations firm met with Governor Hochul, Andrew Cuomo and other New York Department of State regulators and legislators to discuss the topic. All parties agreed that a legislative change was necessary.

“This New York law update ensures that the state will now align with the ISPSC, other state codes on spa cover requirements,” Nathan Coelho (Chair of the IHTA Engineering Committee) and Vice President Engineering at Master Spas LLC. This is a major win for spa owners as well as the industry.

Before reaching Governor Hochul’s desk, the legislation was unanimously passed by both New York State Assembly (NYS) and New York State Senate. The legislation went into effect on the 23rd of November, shortly after its signing.
